Terms of Service

Last updated: October 8, 2026

The short version: you pay an invoice each month for each service you want to keep (or turn on automatic card payments for it), we never charge you automatically unless you turn that on, and you can cancel any time and keep the service until the end of the month you paid for. A service whose invoice is still unpaid 24 hours after it is due is deleted, with everything on it. A new service cancelled within 48 hours is refunded in full. Don't use our servers to attack, spam or defraud anyone. The full terms below are what actually apply.

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Erupted Hosting LLC, a United States limited liability company ("Erupted Hosting", "we", "us" or "our"). By creating an account, placing an order or otherwise using our website or services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use our services.

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or buy a service. If you use our services on behalf of a business or other organization, you confirm that you have authority to bind it to these Terms.

2. Our services

We provide virtual private servers (VPS), game server hosting and Discord bot hosting (the "Services"), as described on our website. The resources included with each plan, such as CPU, memory, storage and bandwidth, are shown on the pricing page when you order.

Once your payment is confirmed we set up your Service. The details you need to use it, such as an IP address or login information, appear in your dashboard. We set up each Service ourselves, so it is not instant: it will be ready within 24 hours of your payment being confirmed, and we will let you know when it is.

We may improve, change or remove features of the Services, and may stop offering a plan to new customers at any time. If we make a change that materially reduces what you paid for on an active Service, we will tell you and you may cancel as described in section 5.

3. Your account

  • Give us accurate information and keep it up to date. Before your first purchase you must add a billing email address and confirm it by clicking the link we send you, give us your full legal name, billing address and phone number, and agree to these Terms and our Privacy Policy. We send invoices, payment receipts and overdue notices to your email, so keep it working and check it.
  • We may ask you to prove who you are. If the details you give us are false or can't be verified, we may refuse an order or suspend or end your services.
  • We currently sell the Services only to customers with a billing address in the United States.
  • You confirm that you are not located in, and will not use the Services from, a country or region subject to comprehensive United States sanctions or embargoes, and that you are not on a United States government list of restricted parties. We may refuse or end service where the law requires it, or where we reasonably believe this isn't true.
  • Keep your password confidential. You are responsible for everything done through your account, and for your servers' own passwords, keys and software updates.
  • Tell us right away if you think someone has accessed your account without permission.
  • One person or organization per account. Don't share or sell your account.
  • A Service is for your own use. Other people may use what you run on it, such as players on your game server or visitors to your site, but you may not resell, rent out or sublicense the Service itself without our written permission.

4. Orders, billing and payment

4.1 Monthly billing

Services are billed monthly in U.S. dollars unless we say otherwise. Placing an order creates an invoice for the first month. Each paid invoice covers one month of service.

4.2 Invoices and automatic payments

Unless you turn on automatic payments, we do not charge you automatically. About a week before your paid period ends we issue a renewal invoice, which you pay from your Service's page in the Portal. If you don't pay it, the Service is not renewed, and it is deleted as described in section 4.7.

When you pay for a Service by card, you can choose to pay automatically. If you do, you authorize us, through Stripe, to charge that card the Service's monthly price (plus any applicable tax) each month when the Service renews, until you turn automatic payments off, cancel the Service, or we end it. You can turn automatic payments off at any time from the Service's page; that stops future charges but does not refund a month already charged. Cancelling a Service also turns them off. If an automatic payment fails, we turn automatic payments off for that Service, issue the renewal invoice, and email you so you can pay it another way.

We email your confirmed billing address when a renewal invoice is issued, when a payment is received, and when a service becomes overdue, but you remain responsible for paying on time even if an email doesn't reach you.

4.3 Payment methods

Depending on what we have enabled, you can pay by credit or debit card (processed by Stripe) or by PayPal. These providers process your payment under their own terms and privacy policies, and we never see or store your full card number. We may add, change or remove payment methods at any time, and not every method may be available for every invoice.

4.4 When an invoice counts as paid

An invoice is paid when our payment provider confirms that we have received the full amount. Each paid invoice extends your Service by one month from the end of your current paid period, or from the date of payment if your Service had already expired.

4.5 Prices

The monthly price you pay for a Service is the price shown when you ordered it. We may change prices for new orders at any time. If we ever change the price of an existing Service, we will tell you at least 30 days before it takes effect, and you may cancel before then.

4.6 Taxes

Our prices do not include sales tax, value added tax (VAT), goods and services tax (GST) or similar taxes. Where tax applies to your purchase, it is calculated at checkout by our payment processor, Stripe, from your billing address, and added to the price. You are shown the full amount, including any tax, on Stripe's checkout page before you confirm the payment, and the tax is itemized on the receipt Stripe sends you. If you turn on automatic payments, tax is calculated the same way on each monthly charge. The invoices in your Portal show our price before tax. You are responsible for any other taxes that apply to you.

4.7 Late and unpaid invoices

If a renewal invoice is not paid by its due date, which is the end of your paid period, the Service becomes overdue and we may suspend it. If the invoice is still unpaid 24 hours after its due date, we terminate the Service: it is permanently deleted, together with all of its data, and removed from your account, and the unpaid invoice is cancelled. Deleted data cannot be recovered. We may allow more time at our discretion, for example while a payment is being processed. Please pay in time, or download anything you want to keep first.

4.8 Payment disputes and chargebacks

If you think a charge is wrong, please contact us first so we can fix it quickly. If you open a chargeback or payment dispute instead, we may suspend your account and Services while it is investigated, and if the dispute is decided in our favor, or you withdraw it, you agree to pay any dispute fees we incur.

5. Cancellation and refunds

You can cancel a Service at any time from your dashboard. Cancelling stops future renewals and the Service keeps running until the end of the period you have already paid for, then it is shut down and its data deleted. You may change your mind and resume the Service any time before that date.

Money-back window for a new Service

If you change your mind about a new Service, tell us and:

  • within 48 hours of placing the order, we cancel it and refund your payment in full;
  • after that, and up to 14 days after the Service started, we cancel it and give you account credit for the part of the month you have not used.

This covers the first payment for a new Service, not renewals, and it does not apply where we suspend or end a Service because these Terms were broken (section 9). Account credit is taken off your future invoices; it cannot be paid out as cash.

Other refunds

Outside that window, payments are non-refundable, including for the unused part of a month, except:

  • where we fail to provide a Service you paid for, in which case we will, at your choice, refund or credit the affected period;
  • where a change we make materially reduces what you paid for and you cancel promptly (section 2); and
  • where the law where you live gives you a right to a refund that we cannot exclude.

Approved refunds are made to the original payment method where possible. To cancel within the money-back window or request a refund, email [email protected] or open a support ticket, so that we hear from you within the time allowed.

6. Acceptable use

You may only use the Services for lawful purposes and in line with these rules. You must not use, or allow anyone else to use, a Service to:

  • host, store or share illegal content, or content that exploits or endangers children (we report this to the authorities and terminate immediately);
  • infringe copyright, trademarks or other rights, including hosting pirated software, media or game copies;
  • send spam or bulk unsolicited messages, or host phishing, scam or fraud sites;
  • distribute or run malware, botnets or command-and-control servers, or exploit or gain unauthorized access to any system;
  • launch or take part in denial-of-service attacks, port scans, brute-force attempts or any other attack on a network, service or person;
  • mine cryptocurrency, or run other workloads that consistently use far more resources than your plan is meant for or that harm other customers;
  • run open proxies or relays, or anonymization services, without our written permission;
  • host Discord bots that break Discord's rules, including self-bots, mass unsolicited messaging, and scraping or harvesting user data; or
  • run game servers in breach of the game publisher's terms, or that distribute cheats or hacks that harm other players.

We investigate abuse reports and may act on them without notice. We may cooperate with law enforcement and other authorities. Report abuse to [email protected].

Our website and Portal

The same goes for our own website, Portal and systems. You must not:

  • probe, scan or test them for weaknesses, or try to get around their security;
  • access, or try to access, an account, server or data that is not yours;
  • disrupt them, for example by flooding them with requests or uploading malicious code;
  • collect their content with scrapers, crawlers or other automated tools (search engines indexing our public pages are fine); or
  • copy, republish or sell our website's content or design without our written permission.

If you find a security problem, please tell us at [email protected] rather than testing it further.

Copyright complaints (DMCA)

Our designated agent for copyright notices is:

Copyright Agent, Erupted Hosting LLC
6545 Market Ave. North, Ste 100, Canton, OH 44721, United States
Email: [email protected]

If you believe content on our Services infringes your copyright, send the agent a notice that includes: (a) a description of the copyrighted work; (b) where the allegedly infringing material is located, such as its URL or IP address; (c) your name, address, phone number and email; (d) a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature.

We respond to valid notices under the U.S. Digital Millennium Copyright Act, which may include removing or disabling access to the material and passing your notice on to the customer. If you believe material was removed by mistake, you can send us a counter-notice with the details the law requires. In appropriate circumstances we terminate the accounts of repeat infringers.

7. Your content and backups

You keep all rights to the files, software, data and other content you put on your Service ("Your Content"). You give us permission to store, copy and transmit it only as needed to run the Services, keep them secure, and comply with the law. You are responsible for Your Content and for having the rights to it.

We do not routinely look at Your Content. We may access a Service when needed to provide support you ask for, to investigate abuse or security problems, or to comply with legal requirements.

We are not responsible for backing up Your Content unless the plan description for your Service specifically says that backups are included. If a plan does not say so, no backups are made and you are solely responsible for keeping your own copies of anything important. Where a plan does include backups, they are a convenience and not a guarantee: we do not promise that any backup will exist, be complete, or be restorable, and we are not liable for lost or corrupted data. When a Service is cancelled or terminated, its data is deleted and we may not be able to recover it.

8. Availability and support

We work to keep the Services running and to protect them from attacks, but we do not guarantee that they will be uninterrupted, error-free or secure. Maintenance, upgrades, hardware or network failures, attacks and events outside our control can cause downtime. Any DDoS protection reduces risk but cannot stop every attack.

We provide support through the contact options on our website. We aim to respond promptly, but we don't promise specific response or resolution times. Support covers the Service itself, not the software or games you run on it.

If you contact support you may attach screenshots. Only attach images you have the right to share, and never include passwords, payment card details or other people's personal information. We keep a record of support conversations, including images and a log of who did what, and may use it to handle your request, resolve disputes and enforce these Terms. Images that break the acceptable use rules above can lead to suspension under section 9.

Priority support

Priority support is an optional paid extra for your account. While it is active, the support tickets you open are placed ahead of other tickets in our queue. It applies to your whole account, not to one Service, and an account can have it once. It changes the order in which we answer tickets. It does not change what support covers, and we still don't promise specific response or resolution times.

Priority support is billed monthly, separately from your Services, at the price shown when you add it. Section 4 applies to it as it does to a Service: you pay an invoice for each month from the Support page in the Portal, or turn on automatic card payments for it, and it is not renewed if its invoice is not paid. If a renewal invoice is unpaid when your paid period ends, priority support stops until the invoice is paid, and your tickets are answered in the normal order. Promo codes and referral codes do not apply to priority support.

You can stop priority support at any time from the Support page. It stays active until the end of the month you have already paid for, then it ends and you are not charged again. Stopping it does not affect your Services, and cancelling a Service does not stop priority support. The money-back window in section 5 is for new Services and does not cover priority support. Payments for it are refundable only as described under "Other refunds" in section 5.

9. Suspension and termination

We may suspend or terminate your account or any Service, immediately and without a refund, if you break these Terms, if we reasonably believe your use puts our systems, other customers or third parties at risk, if we are required to by law, or if a payment is reversed or unpaid. Where it is reasonable and safe to do so, we will try to warn you and give you a chance to fix the problem first.

You may stop using the Services at any time and may ask us to close your account. Sections that by their nature should continue after termination, including those on payment, liability and disputes, will continue to apply.

10. Third-party services

Our Services and website work with services we don't control, including payment providers (Stripe, PayPal), Discord, game publishers and their software. Your use of them is subject to their own terms, and we are not responsible for them.

11. Intellectual property

The Erupted Hosting name, logo, website and the software we run to provide the Services belong to us or our licensors. These Terms don't give you any right to them except to use the Services as intended. If you send us feedback or suggestions, we may use them without obligation to you.

Reviews: customers who have paid for a Service may post a review. It must be honest, based on your own experience, and follow the acceptable use rules above (no links, advertising, or content about other people). By posting one you give us a free, non-exclusive licence to display it, with the display name you chose, on our website and marketing while it is live. We may decline, hide or remove any review, for example if it is abusive, misleading or not about our Services, and you can edit or delete yours at any time.

12. Disclaimers

The Services and our website are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Services will meet your requirements or be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunities, arising from or related to the Services or these Terms, even if we were told they were possible.

Our total liability for all claims relating to the Services or these Terms is limited to the amount you paid us for the affected Service in the three months before the event that gave rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, where the law where you live does not allow it to be excluded.

14. Indemnification

You agree to defend and compensate us, and our owners and staff, against claims, losses and costs (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms or of the law.

15. Changes to these terms

We may update these Terms from time to time. When we make a material change we will post the new version here with a new "Last updated" date and, for changes that affect your active Services, give you reasonable notice through your account or by email. If you keep using the Services after a change takes effect, you accept the updated Terms. If you don't agree, you can cancel before the change applies.

16. Governing law

These Terms are governed by the laws of the State of Ohio and applicable United States federal law, without regard to its conflict-of-law rules. Any dispute that we can't resolve informally will be brought in the state or federal courts located in Ohio, United States Of America, and you and we consent to their jurisdiction. Before starting a formal dispute, please contact us so we can try to resolve it. If you are a consumer, you may also have rights under the mandatory laws of the place where you live, and nothing here removes them.

17. General

  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Services.
  • If part is unenforceable. The rest of the Terms continues to apply.
  • No waiver. If we don't enforce a right straight away, we haven't given it up.
  • Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours, for example if we sell the business.
  • Events beyond our control. We are not responsible for delays or failures caused by events we can't reasonably control.
